Terms of Service

1. Acceptance of Terms
Welcome to Synceria! These Terms of Service ("Terms") govern your use of the Synceria mobile application and related services (collectively, the "Service") provided by Vibin LLC (DBA Synceria) ("Company," "we," "us," or "our").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. We may update these Terms and require re-acceptance for material changes.
2. Eligibility
To use Synceria, you must:
- Be at least 18 years of age
- Be located in the United States, where Synceria is currently available
- Be legally able to enter into a binding contract
- Not have been previously banned from Synceria. If we determine that a new account belongs to a previously banned user, the account will be terminated immediately.
By using the Service, you represent and warrant that you meet all eligibility requirements and that the information you provide is accurate and complete.
3. Your Account
3.1 Account Creation
You must create an account to use Synceria. You may create your Synceria account by providing your email address and password or by using "Sign in with Apple" or "Sign in with Google." When using these third-party authentication options, you authorize us to access and store the information those services provide (such as your name and verified email) to set up your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you choose to authenticate through Google or Apple, you are responsible for maintaining the security of your Google or Apple credentials. Any activity occurring under your Google or Apple account will be deemed authorized by you. Please ensure your third-party account is protected with strong authentication (e.g., two-factor authentication). Notify us immediately of any unauthorized use.
3.3 One Account Per Person
You may only create and maintain one account. Creating multiple accounts may result in termination of all accounts.
4. User Content and License
You retain ownership of content you post ("User Content"). By posting User Content, you grant us a non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, modify (for formatting and moderation), and distribute your content in connection with the Service.
You represent that you have the rights to your User Content and that it does not violate these Terms or applicable laws. We may remove content that violates these Terms or our Community Guidelines.
5. Prohibited Conduct
You agree not to:
- Harass, stalk, threaten, or abuse other users
- Impersonate any person or entity or misrepresent your identity
- Post content that is illegal, hateful, discriminatory, or sexually explicit
- Share personal or financial information of others without consent
- Use the Service for commercial purposes without authorization
- Use automated means to access the Service (bots, scrapers)
- Interfere with or disrupt the Service or its security
- Violate any applicable laws or regulations
6. Reporting, Moderation, and Appeals
You can report profiles or messages in-app or by emailing admin@vibinllc.com. We review reports and may take enforcement actions including warnings, suspensions, or permanent bans.
Automated moderation: Photos uploaded to Synceria are automatically analyzed using AI-based content moderation (Google Cloud Vision SafeSearch) to detect prohibited content. Photos that are flagged may be removed or queued for human review. No photo data is retained by the AI service after analysis.
Appeals for suspensions or bans are available via email to admin@vibinllc.comwith the subject line "Appeal: Ban or Suspension." We may request additional information to review an appeal.
7. Nonconsensual Intimate Image Removal (TAKE IT DOWN Act)
7.1 Definition
For purposes of this Section, "Nonconsensual Intimate Image" (NCII) has the meaning given in 47 U.S.C. §1401 — an intimate visual depiction of an identifiable individual that was disclosed without that individual's consent. The term covers both adult and minor depictions and includes digitally fabricated or AI-generated depictions of real persons.
7.2 How to submit a removal request
You may submit an NCII removal request in any of the following ways:
- Use the in-app report flow (Settings > Report a User, or the report icon in any profile or message context) and select "Intimate Image Without Consent."
- Use the publicly accessible web form at synceriaapp.com/ncii-removal. No Synceria account is required.
- Email admin@vibinllc.com with the subject line "NCII Removal Request."
A valid request must include: identification of the content (URLs, descriptions, or in-app references); your contact information; a good-faith belief statement that the content qualifies as NCII and that the depicted person did not consent to its disclosure; and your electronic signature.
7.3 48-hour removal commitment
Synceria will action valid NCII removal requests within 48 hours of receipt, as required by 47 U.S.C. §1402(c)(1). If a request lacks the information required to verify it, we may return it for clarification, in which case the 48-hour clock restarts on the corrected submission.
7.4 Re-upload prevention
Synceria takes reasonable technological measures to prevent the re-upload of content removed under this Section, including by computing perceptual fingerprints (digital hashes) of removed content. These hashes do not contain or reveal the original image and cannot be used to reconstruct it. Hashes are retained for as long as the content remains identified as NCII; see our Privacy Policy §8 for detail.
7.5 Good-faith safe harbor
Synceria's removal of content in good-faith compliance with a request made under this Section shall not, in and of itself, constitute a violation of this Agreement, the Synceria Community Guidelines, or any other terms applicable to a User. Where Synceria determines after removal that a request was invalid, fraudulent, or made in bad faith, Synceria will reasonably restore the affected content and notify the original uploader. Nothing in this Section limits the immunity provided by 47 U.S.C. §230 or applicable state-law analogues.
7.6 Bad-faith requests
Submission of an NCII removal request known to be materially false, made for the purpose of harassment, or made without a good-faith belief that the content qualifies as NCII may result in (i) rejection of the request, (ii) suspension or termination of any associated Synceria account, (iii) referral to law enforcement, and (iv) civil liability under applicable law including the TAKE IT DOWN Act.
7.7 Appeal mechanism
If Synceria removed content under this Section and you believe the removal was in error, you may appeal by emailing appeals-ncii@vibinllc.com with (i) the moderation/request reference number you received, (ii) a statement under penalty of perjury that you have a good-faith belief the content was removed in error, (iii) your full legal name and mailing address, and (iv) consent to be contacted at the email address from which you sent the appeal. Appeals are reviewed by a Synceria administrator, typically within 5 business days. If the appeal is granted, the affected content is restored and any associated re-upload-prevention hash is deactivated. If the appeal is denied, you will receive a written explanation. Repeated bad-faith appeals may result in account action.
7.8 Statutory good-faith attestation
Each NCII removal request you submit (whether in-app, via the web form, or by email) is made under the following attestation:
"Under penalty of perjury, I have a good-faith belief that the content I am identifying depicts an intimate visual depiction within the meaning of the TAKE IT DOWN Act (S.146, codified at 47 U.S.C. §§1401 et seq.), that the depicted individual did not consent to the publication of such depiction, and (where applicable) that I am the depicted individual or am authorized to act on the depicted individual's behalf. I understand that knowingly making a materially false statement on this form may subject me to civil and criminal liability."
7.9 Transparency reporting
Synceria publishes a periodic transparency report summarizing the volume of NCII removal requests received, the proportion resolved within the 48-hour SLA, and the number of requests rejected as invalid or bad-faith. Aggregated, anonymized request metadata may be retained indefinitely for transparency reporting; personally identifying request data is retained per the Privacy Policy.

8. Safety Policy (Colorado SB24-011)
The following Safety Policy is part of these Terms and applies to all users. It summarizes our safety practices and reporting expectations.

- Prohibited conduct: Harassment, threats, hate speech, scams, impersonation, non-consensual sexual content, and any illegal activity
- Background checks: We do not conduct background screenings of members
- Identity/age verification: We do not verify identity or age beyond user-provided information
- Member notifications: We do not routinely notify other members who had contact with a reported user
- Enforcement: Warnings, suspensions, bans, and law enforcement referral where appropriate
- Appeals: Email-based appeals to admin@vibinllc.com with subject "Appeal: Ban or Suspension"
- Consent statement: Sexual conduct without consent is prohibited and may result in criminal or civil liability

Child Safety Standards
Synceria is intended solely for adults aged 18 and over, and we take the protection of minors very seriously. We maintain a zero-tolerance policy toward any content or conduct that exploits, endangers, or depicts minors. If we discover that an account belongs to someone under 18, or that an adult user is engaging with a minor through our service, the account will be terminated immediately and the appropriate authorities will be notified. Any reports of suspected child exploitation-including grooming, trafficking, harassment, or the sharing of explicit material involving minors-will be investigated promptly. We encourage users to report any behavior or content that may involve a minor; doing so helps us uphold the safety of our community and comply with all applicable laws regarding the protection of children.
9. Safety and Interactions
Synceria is a platform for meeting new people, but we cannot guarantee the behavior of other users. You are solely responsible for your interactions with other users.
- Never share financial information or send money to other users
- Meet in public places for first meetings
- Tell a friend or family member about your plans
- Trust your instincts and report suspicious behavior
We do not perform background checks or identity verification, and we do not guarantee that user-provided information is accurate.
10. Subscriptions and Payments
9.1 Free and Paid Features
Synceria offers both free features and premium subscription tiers. Premium features are only available to paying subscribers.
9.2 Billing and Auto-Renewal
Subscriptions are billed through the Apple App Store or Google Play Store, and managed by RevenueCat. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
9.3 Cancellation and Refunds
You can manage or cancel subscriptions in your device's account settings (Apple: Settings > Apple ID > Subscriptions; Google: Play Store > Payments & Subscriptions). Refunds are handled by Apple or Google according to their policies. We do not process refunds directly. Deleting the app does not cancel your subscription. You must cancel through your device settings.
9.4 One-Time Purchases
In addition to subscriptions, Synceria offers one-time, consumable in-app purchases, including Weekend Passes, Day Passes, and Unlock 3 Likes packs. These purchases are non-recurring and are processed through the Apple App Store or Google Play Store. One-time purchases are consumed upon use and are non-refundable except as required by applicable law or Apple/Google refund policies. One-time purchases do not auto-renew and do not grant permanent access to premium features.
11. Third-Party Services
Synceria integrates with third-party services including Apple Music API (music catalog search), Stream (chat), Supabase (backend infrastructure), RevenueCat (subscription management), PostHog (product analytics), Sentry (crash reporting), Google Cloud Vision (photo moderation), Expo and Apple/Google push notification services, Upstash Redis (rate limiting), and Resend (transactional email). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services. For a complete list of service providers and the data shared with each, see Section 5 of our Privacy Policy.
Our Service uses identity providers such as Apple and Google for optional authentication. Your use of these authentication services is subject to the terms of service and privacy policies of the respective providers. Synceria is not responsible for those providers' services or for the accuracy of the information they provide us. By using these sign-in options, you also agree to abide by their terms.
12. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Service, you agree to the Privacy Policy.

To request data deletion, you may use the in-app account deletion feature (Settings > Account > Delete Account) or visit synceriaapp.com/delete-account. You may also request a portable copy of your personal data through the app (Settings > Account > Export My Data). Exports are provided in a machine-readable format. For details on data portability and your privacy rights, see Section 10 of our Privacy Policy.
13. Intellectual Property
The Service, including its design, features, and content (excluding User Content), is owned by Vibin LLC and protected by copyright, trademark, and other intellectual property laws.
"Synceria," our logo, and related marks are trademarks of Vibin LLC. You may not use our trademarks without prior written permission.
14. Termination
13.1 By You
You may delete your account at any time through the app settings. Account deletion is scheduled for 30 days after your request, during which you may cancel the deletion. If you cannot access the app, you can submit a request at synceriaapp.com/delete-account.
13.2 By Us
We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. We may also terminate the Service entirely with reasonable notice.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT GUARANTEE THAT YOU WILL FIND A MATCH OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBIN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
17. Indemnification
You agree to indemnify and hold harmless Vibin LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
18. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA), except that either party may bring claims in small claims court if they qualify. You and Vibin LLC waive the right to a jury trial and to participate in a class action.
The arbitration will take place in Pennsylvania, and Pennsylvania law will govern the arbitration agreement. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@vibinllc.comwith the subject line "Arbitration Opt-Out" and your name, email, and Synceria user ID.
19. General Provisions
- Governing Law: These Terms are governed by the laws of the Commonwealth of Pennsylvania.
- Entire Agreement: These Terms constitute the entire agreement between you and us.
- Severability: If any provision is unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce a provision does not waive our right to do so later.
